Biographical Sketch
Ralph J. Erickstad was born August 15, 1922, on his parents' farm at Starkweather, North Dakota. He is of Norwegian ancestry. His father, John T. Erickstad, was born in Norway in 1880, came to North Dakota at three years of age, and attended only three winters of boarding school in Devils Lake. His mother, Anna Louisa Myklebust was born in 1884, near Iola, Wisconsin. She met John while teaching school in rural Ramsey County. Ralph was one of six children, four brothers, Alton, Lloyd, Rollin, Irvin, and a sister, Luella. Only Ralph, Alton, Lloyd, and Luella lived to adulthood.
Ralph received his elementary and high school education in Starkweather, then he attended the University of North Dakota from 1940-1943. After serving in World War II, he was graduated from the University of Minnesota with a B.S. in 1947 and an LL.B. in 1949. The latter degree was later converted into a Juris Doctor degree by the university.
While attending the University of Minnesota, Ralph met and married Lois Katherine Jacobson in 1949. Lois earned a bachelor's degree in business administration from the University of Minnesota and a master's degree in public administration from the University of North Dakota. They had two sons, John and Mark, both physicians in Bismarck, and five grandchildren, Jessica, Jennifer, Katherine, Michael, and Karen.
From 1943-1945, Ralph served in the U.S. Army Air Corps, part of which time he served in the Eighth Air Force in the European Theater of War during World War II. He was a radio operator and machine gunner as a member of a Liberator Bomber crew. Among other medals he was awarded the air medal with an oak leaf cluster.
After passing the bar in 1949, he practiced law in Devils Lake until 1962. He served as police magistrate from 1950-1953 and state's attorney from 1953-1957. He was a member of the Legislative Research Committee from 1957-1959. During his tenure in the state senate he was assistant majority floor leader, and from 1961-1963 he was also a member of the state budget board.
When he was elected to his first ten-year term on the North Dakota Supreme Court in 1962, he resigned from the legislature. He was reelected for ten-year terms on the Supreme Court in 1972 and 1982. In 1973, he was elected chief justice by the judges of the District Court and the Supreme Court and reelected chief justice for five-year terms in 1978, 1983, and 1987. He retired December 31, 1992. He was then appointed surrogate judge on January 5, 1993.
During his term of office as justice and chief justice of the North Dakota Supreme Court, Justice Erickstad served on many national committees. He was a member of the task force on "The Public Image of the Courts," Williamsburg Conference, in 1978. He served five years as a member of the Executive Council of the National Conference of Chief Justices. In 1983, he was elected president of the National Center for State Courts and the Conference of Chief Justices. President Reagan appointed Justice Erickstad, in July 1987, to the Board of Directors of the State Justice Institute. As a member of the eleven member board of directors he participated in awarding federal funds to various grantees nationwide for the improvement of the judicial systems throughout the states and territories of the United States.
Justice Erickstad was a member of several legal associations and veterans' organizations and received many honors. He was a former Council Commissioner for the Missouri Valley Council of the Boy Scouts of America and was past chairman of the Board of Trustees of the Missouri Valley Family YMCA. He received the Silver Beaver Award, Boy Scouts of America, in 1967; the Frontier Trails District, Northern Lights Council, Boy Scouts of America, named the 1983 "Chief Justice Ralph J. Erickstad, Eagle Class" in his honor; he received the First Distinguished Service Award, Missouri Valley YMCA, in 1978; and, along with the other members of the Supreme Court, he received the Sioux Award from UND in 1973. On November 23, 1987, he received the North Dakota National Leadership Award of Excellence from Governor George Sinner, and on June 10, 1988, he was presented with the Distinguished Service Award by the State Bar Association of North Dakota. On May 24, 1989, he received a Distinguished Service Award from the National Center for State Courts for his contributions to improved court administration, both nationally and in the state of North Dakota. On December 22, 1992, he was presented with the Herbert Harley Award by the American Judicature Society.
Judge Erickstad died in Bismarck on July 12, 2001.
Scope and Content:
The collection, dating from 1952-1992 and measuring 350 feet, has three major groupings:
The first group (boxes 1-110) consists of files associated with the North Dakota Supreme Court cases and is arranged according to case number. It measures 110 feet and includes an index summarizing each case.
The second group (boxes 111-232) consists of general files. Both a set of preliminary lists with a box folder list and an alphabetical list of file folders have been created.
The final portion of this collection includes over 800 publications. A bibliography of the titles has been developed.
These papers covering Justice Erickstad's thirty years on the North Dakota Supreme Court provide the reader with a survey of North Dakota life as it appeared to the state's judiciary. Many questions that became front page news are detailed in these cases. Some involved legislative election contests; serious crimes including murder cases (one of which was appealed to the United States Eighth Circuit Court of Appeals and affirmed with remand for further proceedings); civil issues including the issues of judicial jurisdiction within Indian country, two of which cases were appealed to the United States Supreme Court, where one opinion was vacated and the other was reversed. Another civil decision was reversed by the United States Supreme Court when that court reversed a longstanding decision of that court upon which decision the North Dakota Supreme Court, with Justice Erickstad as author, had relied. One case sought a decision on when the incoming governor, George A. Sinner, should take office from the incumbent, Allen I. Olson, which was significant because it determined which governor could fill two vacancies on the North Dakota Supreme Court.
Many of the cases Justice Erickstad participated in as a justice on the Supreme involved important topics in the modern world: energy rights, medical malpractice, legality of breathalizer tests, labor relations between school boards and teachers, divorce property settlement, child custody and support disputes, workers compensation, home-based instruction, urban renewal property condemnation, attorney malpractice, farm and mortgage foreclosures, open records law, relations between Indian tribes and the state, product liability, and commitment of the mentally ill and the homeless.

We are closed New Year's Day, Easter, Thanksgiving Day, and Christmas Day. We are closed at noon Christmas Eve if it falls on Mon.-Thurs. and are closed all day if it falls on Fri.-Sun.
